A Call for Action: Addressing the Tragic Petrol Tanker Fire Incident in Niger State

A Call for Action: Addressing the Tragic Petrol Tanker Fire Incident in Niger State

The Nigerian Bar Association (NBA), Minna Branch, expresses profound shock and sorrow over the petrol tanker fire explosion at Dikko Junction, Gurara Local Government Area of Niger State. This tragic incident, which occurred on January 18, 2025, claimed the lives of approximately 80 individuals and left over 50 others with severe burns.

In this challenging time, the NBA Minna Branch extends its heartfelt condolences to the families of the victims and the people and government of Niger State. Such catastrophic accidents highlight critical systemic failures in safety practices, public awareness, and governmental accountability within our nation.

It is deeply alarming that incidents like this continue to occur, resulting in significant loss of life and property. The lack of preventive measures and effective enforcement of safety regulations places citizens’ well-being at risk.

Nigerian law clearly stipulates that the owner and driver of the tanker have a duty of care to the public. Section 343 of the Nigerian Criminal Code Act emphasizes the necessity of taking precautions while handling dangerous substances.

It is imperative for fuel tanker operators to ensure their vehicles are roadworthy, to comply with traffic regulations, and to follow established safety protocols in transporting hazardous materials. In the event of an accident, it is incumbent upon them to notify relevant authorities, such as the Police and Fire Service, immediately to mitigate the risks of fire and explosion.

The fundamental responsibility of governments, as enshrined in Section 14(2)(b) of the 1999 Constitution of the Federal Republic of Nigeria (as amended), is to secure the welfare of its citizens.

The failure to deploy adequate security and emergency response teams at accident sites represents a grave negligence on the part of government authorities. Judicial precedent, as established in cases like Amodu Tijani v.The Secretary, Southern Nigeria (1921) AC 399, underscores the duty of the government to act in the best interest of its populace during life-threatening emergencies.

While socioeconomic factors may lead individuals to engage in unsafe practices, such as siphoning fuel from accident sites, these actions remain both perilous and illegal. It is critical to educate the public on the dangers of interacting with hazardous materials. Existing regulations, including the Environmental Impact Assessment Act, strictly prohibit unauthorized interference at such accident sites.

To avert future tragedies, the NBA Minna Branch calls upon the Niger State Government to take immediate action in providing compensation to the victims’ families and those injured from this incident.

The principles established in cases such as Ogwuche v. Federal Roads Maintenance Agency (FERMA) (2011) LPELR-CA/J/43/09 highlight the state’s responsibility to compensate victims of preventable accidents.

Furthermore, the government must prioritize the establishment and equipping of emergency response units to effectively manage accidents involving hazardous materials. This includes deploying police and fire service personnel to secure accident locations, in accordance with the provisions of the Petroleum Act and related regulatory frameworks.

Comprehensive awareness campaigns are essential to educate citizens on the perils of mishandling hazardous substances and the legal ramifications of such actions. Efforts should encompass community outreach, school programs, and mass media engagement.

To prevent future incidents, the Federal Road Safety Corps (FRSC) must rigorously enforce safety regulations governing the transportation of hazardous materials. This includes implementing periodic vehicle inspections, driver training, and stricter licensing requirements.

The Nigerian Bar Association, Minna Branch, remains committed to advocating for justice for the victims of this tragedy. We will work closely with relevant authorities and stakeholders to push for necessary reforms, accountability, and appropriate compensation.

This incident serves as a crucial reminder for both the government and citizens to collectively assume responsibility in preventing such occurrences in the future.
