Save The Children NGO Face Charges For Wrongful Termination Of Staff Appointment

An international Non Governmental organization known as Save the Children has been dragged to Court for wrongful termination of her staff appointment
In a suit No. NICN /ABJ/187/2021, between the former staff as Claimant /Respondent and 1. The Board of Trustees of Save the Children 2. The Country Director , Save the Children as Defendants /Applicants , the Claimant said his disengement was wrongly done and so should reverse .
Ruling on the notice of Preliminary Objection dated 17th June 2022 filled on 23rd June 2022 by the defendants , his Lordship , Hon. Justice R.B.Haastrup said ” I am in agreement with the claimant’s Counsel submission that the wrong description of the personality of the 1st defendant does not detract from the fact that it is juristic person in existance which can sue and be sued . I so hold .
“With regard to the legal personality of 2nd defendant, Claimant/Respondent has not been able to show how the position ” The Country Director , Save the Children” is by statute a juristic person, while the 1st defendant has been established to be a creation of statute .
“To my mind , the 2nd defendant from the foregoing facts and authorities it is not juristic person and consequently cannot be sued as such, it is on this footing that I find that 2nd defendant was wrongly joined as a party and the name is accordingly struct out from the suit .
Flowing from the above , i find this application to be meritorious in part and it is ordered as follows 1. The name of the 2nd defendant is struct out as a party from this suit 2. The Claimant /Respondent is ordered to file a relevant process to amend the name of the 1st defendant to it’s pepper name . Ruling is hereby entered “.
